President of the Republic returns Traffic Act to Parliament, as it contains errors

The President, Mr. Toomas Hendrik Ilves, has not proclaimed the Act on the Amendment of the Traffic Act and Related Acts, which was passed by the Riigikogu on 16th December, and he has sent it back to the Riigikogu.

“If this Act was to become effective, it would not be clear and explicit as to which act for regulating traffic is applicable in Estonia on 1st January 2011. Ignoring the traffic regulations is punishable and damages that have been caused must be compensated. A situation in which the entities participating in traffic in Estonia have no objective knowledge of their rights and duties in traffic conflicts with the principles of a state that is based on the rule of law and legal clarity,” President Ilves explained.

According to the Head of State, the Riigikogu could convene an extraordinary and emergency session to eliminate any contradictions in the act concerned, related to the date of enforcement.

“Every day all of us are affected by the laws that regulate traffic. Everything must be explicit in this area,” President Ilves added.
